Privacy Policy
ABLEGRID® Privacy Policy
This privacy policy has been compiled to better serve those who are concerned with how their 'Personally Identifiable Information' (PII) is being used online. PII, as described in US privacy law and information security, is information that can be used on its own or with other information to identify, contact, or locate a single person, or to identify an individual in context. Please read our privacy policy carefully to get a clear understanding of how we collect, use, protect or otherwise handle your Personally Identifiable Information in accordance with our website.
What personal information do we collect from the people that visit our blog, website or app?
Depending on how you interact with our website, store, products, or compatible apps, we may collect information you provide, including your email address, account and contact details, shipping details, support messages, and order-related information. The types of information collected depend on the service you use.
When you use a compatible connected scale or app, information such as weight, body-composition measurements, age, gender, height, device identifiers, and measurement history may be processed as necessary to provide the scale and app functions. The operator of an older third-party app may have its own privacy policy and data practices. ABLEGRID® does not automatically obtain or control all information stored by a third-party app.
When do we collect information?
We collect information from you when you register on our site, place an order, subscribe to a newsletter, Open a Support Ticket or enter information on our site.
We also collect information when you provide feedback on our products or services.
How do we use your information?
We may use the information we collect from you when you register, make a purchase, sign up for our newsletter, respond to a survey or marketing communication, surf the website, or use certain other site features in the following ways:
• To quickly process your transactions.
• To ask for ratings and reviews of services or products
• To follow up with them after correspondence (live chat, email or phone inquiries)
• To send permitted marketing emails, newsletters, product announcements, app-related information, and special offers, subject to the marketing choices and limitations described below. You may unsubscribe from promotional emails at any time.
Affiliated Brands and Email-Only Marketing
ABLEGRID® and I ♥ HEALTH® are affiliated brands. Where permitted by applicable law and consistent with the privacy notices and marketing choices applicable when the information was collected, ABLEGRID® may use customer email addresses only to send joint brand announcements, dietary supplement offers, special discounts, and other affiliated-brand promotional emails. An affiliated brand may receive a customer's email address for that limited purpose only when the transfer and proposed use are lawful.
Strict prohibition on other affiliate-marketing data: No other customer personal information may be provided to, accessed by, or used by an affiliated brand for advertising, audience segmentation, promotional targeting, or marketing. This prohibition includes names, phone numbers, postal addresses, age, date of birth, gender, height, weight, BMI, body-fat percentage, body-composition measurements, health or fitness records, connected-device or app usage history, purchase and payment history, and other profile or behavioral information.
Body measurements and other health-related information collected or processed in connection with connected scales and compatible applications are used for the applicable device or application service and not for affiliated-brand supplement marketing. Affiliated-brand marketing will not be personalized using such measurements or sensitive information.
We may use an authorized email delivery service provider, including Twilio SendGrid, to deliver permitted marketing emails and administer email delivery, complaints, unsubscribes, and suppression records. Information processed by such a provider is limited to what is reasonably needed for these services and is not permission for affiliated brands to use additional personal information for marketing.
Choice and prior commitments: You may unsubscribe using the link in any promotional message or contact us at Legal_dept@ablegrid.com. Applicable opt-out choices will be honored for affiliated-brand marketing, and we may retain the minimal email suppression information needed to respect those choices. Changes to this policy do not, by themselves, retroactively authorize a new use of information previously collected under different privacy commitments; we will provide additional notice or obtain consent where required.
How do we protect your information?
We offer products as well as informational content. Payment card information entered during checkout is handled by the applicable payment processor or e-commerce provider. We seek to apply reasonable administrative, technical, and organizational safeguards appropriate to the nature of the information we handle.
Your personal information is contained behind secured networks and is only accessible by a limited number of persons who have special access rights to such systems, and are required to keep the information confidential. In addition, all sensitive/credit information you supply is encrypted via Secure Socket Layer (SSL) technology.
We implement a variety of security measures when a user places an order to maintain the safety of your personal information.
All transactions are processed through a gateway provider and are not stored or processed on our servers.
Do we use 'cookies'?
Yes. Cookies are small files that a site or its service provider transfers to your computer's hard drive through your Web browser (if you allow) that enables the site's or service provider's systems to recognize your browser and capture and remember certain information. For instance, we use cookies to help us remember and process the items in your shopping cart. They are also used to help us understand your preferences based on previous or current site activity, which enables us to provide you with improved services. We also use cookies to help us compile aggregate data about site traffic and site interaction so that we can offer better site experiences and tools in the future.
We use cookies to:
• Help remember and process the items in the shopping cart.
You can choose to have your computer warn you each time a cookie is being sent, or you can choose to turn off all cookies. You do this through your browser settings. Since browser is a little different, look at your browser's Help Menu to learn the correct way to modify your cookies.
If you turn cookies off, some website features, including shopping-cart or account functions, may not work as intended.
Third-party disclosure
We do not sell customer personal information as a mailing list. We may disclose limited information to service providers that perform services for us, including website hosting, payment processing, order fulfillment, customer support, security, and email delivery, as reasonably needed for those purposes. These service providers are not authorized by us to use the information for their own unrelated marketing.
For affiliated-brand marketing, only customer email addresses may be used or disclosed as described in the "Affiliated Brands and Email-Only Marketing" section above. The other personal information listed in that section must not be used for affiliated-brand marketing. Disclosures necessary to provide an ordered product or requested service are separate from affiliated-brand promotional uses.
Like any other business we are legally obligated to provide information and documentation about your account pursuant to any legal process, such as a court order, a subpoena, other civil discovery, a criminal or administrative warrant. It is our policy to notify you before any data is disclosed, and you may have other privacy rights under the laws of your state. However, as privacy and other relevant laws vary from place to place, and we are neither attorneys nor qualified to advise you about legal matters, you must consult a local attorney if you have any questions regarding your rights in these matters.

California Online Privacy Protection Act
CalOPPA is the first state law in the nation to require commercial websites and online services to post a privacy policy. The law's reach stretches well beyond California to require any person or company in the United States (and conceivably the world) that operates websites collecting Personally Identifiable Information from California consumers to post a conspicuous privacy policy on its website stating exactly the information being collected and those individuals or companies with whom it is being shared. - See more at: http://consumercal.org/california-online-privacy-protection-act-caloppa/#sthash.0FdRbT51.dpuf

Additional U.S. State Privacy Rights
Depending on where you live and whether a particular law applies to our operations, you may have rights to request access to, correction of, or deletion of certain personal information; to learn how we use and disclose it; and to opt out of certain sales, sharing, or targeted advertising practices. Applicable exceptions may apply. To make a privacy request, contact Legal_dept@ablegrid.com. We may need to verify a request before acting on it, as permitted by law.
For connected-scale and application information that qualifies as consumer health data under applicable state law, additional rights, notices, or consents may be required. Where a separate consumer-health-data notice is legally required, it should be made available in addition to this general policy.
How does our site handle Do Not Track signals?
Browser Do Not Track signals are not implemented uniformly across services. Where applicable privacy law requires us to recognize a qualifying opt-out preference signal, we will honor that signal for the practices to which the requirement applies. Please review any available website cookie or privacy settings for additional choices.
Does our site allow third-party behavioral tracking?
We do not provide connected-scale body measurements or other health-related readings to affiliated brands or third parties for targeted dietary-supplement advertising. Website analytics or advertising technologies, if used, must be disclosed and configured consistently with applicable law and customer privacy choices.
COPPA (Children Online Privacy Protection Act)
When it comes to the collection of personal information from children under the age of 13 years old, the Children's Online Privacy Protection Act (COPPA) puts parents in control. The Federal Trade Commission, United States' consumer protection agency, enforces the COPPA Rule, which spells out what operators of websites and online services must do to protect children's privacy and safety online.
We do not specifically market to children under the age of 13 years old.
Fair Information Practices
The Fair Information Practices Principles form the backbone of privacy law in the United States and the concepts they include have played a significant role in the development of data protection laws around the globe. Understanding the Fair Information Practice Principles and how they should be implemented is critical to comply with the various privacy laws that protect personal information.
In order to be in line with Fair Information Practices we will take the following responsive action, should a data breach occur:
We will notify you via email
• Within 7 business days
We also agree to the Individual Redress Principle which requires that individuals have the right to legally pursue enforceable rights against data collectors and processors who fail to adhere to the law. This principle requires not only that individuals have enforceable rights against data users, but also that individuals have recourse to courts or government agencies to investigate and/or prosecute non-compliance by data processors.
CAN SPAM Act
The CAN-SPAM Act is a law that sets the rules for commercial email, establishes requirements for commercial messages, gives recipients the right to have emails stopped from being sent to them, and spells out tough penalties for violations.
We collect your email address in order to:
• Send information, respond to inquiries, and/or other requests or questions
• Process orders and to send information and updates pertaining to orders.
• Send you additional information related to your product and/or service
• Market to our mailing list or continue to send emails to our clients after the original transaction has occurred.

and we will honor your request to stop applicable marketing correspondence. Essential account, order, safety, and security messages may continue when necessary and permitted by law.
Data Retention and Third-Party Apps
We retain personal information in accordance with the purposes for which it was collected, applicable legal obligations, and legitimate operational needs. Different categories of information may have different retention periods. We will not use retained connected-scale health measurements for affiliated-brand marketing.
Some older ABLEGRID® products may have operated with a third-party application. This policy does not independently govern information held by a third-party app provider.
